Adoption Process


Adoption is, for a number of people, the only way they will ever have a family of their own; prospective parents can find the process physically and mentally exhausting. Adoption laws in the U.S. are complex, varying from state to state; this is an area not to be underestimated, because without the compliance of both, it will not proceed. Under the circumstances it is understandable that many people give up before they start; all that is needed however, is an understanding of what is required and expected from adoptive parents in making a successful application.

The definition of is long but in brief, it is where the legal responsibility for a child is transferred to a person or couple who are not the birth parents; sometimes the child may have no family or they are a ward of court. Issues that complicate the selection process are because the new parent(s) must take full legal responsibility for the child; the child can also expect all the rights of a member of his or her new family. Once the process is complete, the adoptive child is considered legal offspring, and has the same rights as any biological child, including the rights of inheritance.

The adoption process must be fair to all concerned, in particular the child, so before it is finalized, the real parents must be made known to the court; this is a safeguard that protects all concerned form any problems later on. Naming the biological parents is not always possible and is governed by state law; this can sometimes happen because the rights of the biological parents had been removed by the courts. There are occasions where the biological parent's rights are terminated at the same time as the adoption is finalized; this can happen when a child has been removed from a teenage single mother.

In all cases the applicants are required to complete what is called a home study review which must be completed before the process is carried out; all applications, irrespective of where they are made in the USA, must carry this out. The purpose of the home study is to provide proof that the adopted child will grow up in a clean, well balanced environment that is safe and secure. To ensure the safety of the child a social worker will carry out checks on any criminal record the applicants may have; they also carefully assess the safety aspect of the home environment plus the medical records of the new parents.

The child can only be assigned to prospective parents once this is completed and if they are approved then a further wait will be necessary for the placement to be granted. The application comes to an end only when the judge finishes his review of both sets of parents (when applicable); then he is able to grant approval. Adoption legislation is constantly changing, both federal and state; in these circumstances it is worthwhile to keep informed of new laws and to know what is expected of an applicant in the state where you live.
